Answer to Question 9

By Bobbie Peachey, About.com

Answer to Question 9:

  • Can I use Microsoft clipart, or any other pics or graphics off the web to create a new business logo?

  • Probably not. Most clip art found on the Web is not totally free for all usage. Almost all clip art found on the Web has terms of usage even for use on your personal Web site. (Most images from a clip art site can be used on your personal Web page for a link back to the site where you downloaded the clip art from.) You should always check each site for terms of usage before using any clip art. Clip art or any content (music, articles, photos, etc.) belongs to the person who creates it and only they have the right to set the terms of usage for that clip art or content. Most clip art found on the Web may not be used on a business Web site or in any business project. You must ALWAYS check the terms of usage before using the clip art for any business purpose. If you cannot find the terms of usage are cannot clearly understand the terms of usage for the clip art or content, then email the Web master, explain fully how you want to use the clip art and ask for permission to use that specific image.

Can I use Microsoft Clip Art preloaded on software purchased for use on home computers in advertising material?

That is a very good question, but I don't know the answer. Assuming that you bought a software package for your computer, there should be terms of usage on that package or box somewhere. Without knowing exactly what you purchased or checking carefully the box or instructions I would not be able to determine the terms of usage for the product.

If you purchased a computer that has Microsoft clip art already loaded on the computer, again, I could not answer your question. I did browse the Microsoft Site online for information. I went to Microsoft Office Online and clicked on Clip Art at the top of the page which pulled up a clip art index list near the bottom of the page.

On the left hand side of this page you will find a list of Providers listed. It seems that several different places (companies) provides images for this clip art. At the bottom of this page click on the word Legal, then click on the words: Copyrighted Materials Permission and read everything that would apply to clip art. Microsoft clip art usage seems to be for personal use only and prohibits the use of Microsoft images for business logos, etc. On the Contact Page, you will find an address, telephone number and fax number where you can send questions to Microsoft. I would certainly verify the usage of the Microsoft clip art that you have before I used it commercially or in advertising materials.
